Terms of Service

By creating an account or using C4tchy Academy you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. Both documents together form the agreement between you and C4tchy Pty Ltd. If you do not agree, do not use the platform.

C4tchy Academy is an AI-powered cricket coaching platform that analyses batting and bowling videos, provides biomechanical feedback, and helps coaches track player progress over time.

C4tchy Academy is not any of the following:

• A qualified coaching service or accredited sports science provider
• A medical, physiotherapy, or rehabilitation service
• A substitute for human coaching judgment

Nothing in the platform — including AI-generated feedback, scores, or recommendations — constitutes professional coaching, medical, or physiotherapy advice. You are responsible for applying any feedback appropriately in consultation with qualified coaches or health professionals where relevant.

To use C4tchy Academy you must:

• Be at least 13 years old (users under 18 require parental or guardian consent)
• Use the platform for legitimate coaching or personal development purposes

By using C4tchy Academy you confirm you meet these requirements.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Contact us immediately at [email protected] if you believe your account has been compromised.

You may use C4tchy Academy only for lawful purposes. You must not:

• Upload videos of individuals without their knowledge and consent
• Upload content that is illegal, defamatory, or infringes third-party intellectual property rights
• Attempt to reverse engineer, decompile, or extract source code from the platform
• Use automated scripts or bots to access the platform in ways not intended by its design
• Resell or sublicense access to C4tchy Academy to third parties without our written consent
• Interfere with or damage the service or other users' access to it

We may suspend or terminate access immediately if we believe these requirements are being breached.

Key billing terms for paid subscriptions:

• Billing platform: Subscriptions are purchased and managed via Stripe. Stripe's terms apply to the payment transaction itself.
• Billing cycle: Monthly or yearly, charged in advance on the date you first subscribed.
• Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel it before the renewal date.
• Top-up credits: One-off credit purchases are charged immediately and are non-refundable once used. Unused credits do not expire.

We reserve the right to change subscription prices. We will give you at least 30 days advance notice of any price increase via email or in-app notification before the change takes effect on your subscription. If you do not accept the new price, you may cancel before your next renewal with no penalty. Continuing to use the service after a price change takes effect on your account constitutes acceptance of the new price.

You can cancel your subscription at any time from the Billing section of your account. Once cancelled:

• Your access continues until the end of the billing period you have already paid for
• You will not be charged again after cancellation
• At the end of the paid period, your account reverts to the Free tier
• Your data is not deleted when you cancel — it remains accessible on the Free tier

Because C4tchy Academy subscriptions are billed through Stripe, refund requests are subject to Stripe's policies.

• Change of mind: We do not offer refunds for cancellations after the billing period has started. You retain access until the period ends.
• Top-up credits: Non-refundable once the purchase is completed.
• Service failure: If C4tchy Academy experiences a material, sustained failure that prevents you from using the service and we cannot fix it within a reasonable time, you may be entitled to a remedy. Contact us at [email protected].

Nothing in this section removes your rights under the Australian Consumer Law — see section 12.

C4tchy Academy uses AI to analyse cricket videos and generate biomechanical feedback. You acknowledge that:

• AI-generated scores, observations, and coaching cues may contain errors
• Accuracy depends on video quality, camera angle, lighting, and model limitations
• You are responsible for reviewing all AI feedback before applying it in coaching or training
• C4tchy Academy is not liable for injury or loss arising from reliance on AI-generated feedback

Videos are processed by Google Gemini and/or Anthropic Claude. Refer to our Privacy Policy (section 5) for details on how this is handled.

Your content is yours. Videos, player profiles, and coaching notes you upload or create in C4tchy Academy remain your property. We do not claim ownership of your content and we do not use it for any purpose other than operating the service for you.

You grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the C4tchy Academy service. This licence ends when you delete your account or delete specific content.

Our intellectual property. The C4tchy Academy platform — including its design, code, AI models, features, and branding — is owned by C4tchy Pty Ltd and protected by copyright and other intellectual property laws. You may not copy, reproduce, or create derivative works from any part of the platform without our written permission.

By uploading a video you confirm you have the right to upload it and that doing so does not infringe any third party's intellectual property, privacy, or other rights.

Nothing in these Terms excludes, restricts, or modifies any right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

Under the ACL, our services come with consumer guarantees that cannot be excluded. If a service fails to meet a consumer guarantee, you may be entitled to a remedy. We commit to:

• Not making misleading or deceptive representations about what C4tchy Academy does or costs
• Providing services with due care and skill
• Ensuring our marketing, pricing, and feature descriptions are accurate

To the maximum extent permitted by Australian law, C4tchy Pty Ltd is not liable for:

• Indirect, incidental, special, or consequential loss arising from your use of C4tchy Academy
• Loss of revenue, profits, data, or business opportunity
• Errors in AI-generated analysis that lead to injury or incorrect training decisions
• Service interruptions caused by third-party infrastructure providers outside our reasonable control

Where liability cannot be fully excluded under Australian law, our total liability to you for any claim arising from your use of C4tchy Academy is limited to the total amount you paid us in the three calendar months immediately preceding the event giving rise to the claim, or AUD $100, whichever is greater.

These limitations do not apply to liability for death or personal injury caused by our negligence, or to liability for fraud.

By you: You may stop using C4tchy Academy and delete your account at any time from your account settings.

By us: We may suspend or terminate your access if you materially breach these Terms. We may terminate immediately, without notice, in cases of serious breach including fraud, illegal activity, or deliberate misuse of the service.

Service discontinuation: If we wind down C4tchy Academy, we will give you at least 60 days advance notice and provide a way for you to export your data before the service closes.

We may update these Terms from time to time. We will give you at least 14 days advance notice of any material changes via in-app notification or email (if we hold your address) before they take effect. Continued use of C4tchy Academy after changes take effect constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be determined by the courts of New South Wales. Both parties submit to the non-exclusive jurisdiction of those courts.
